1. ACCEPTANCE OF TERMS

Welcome to Awesome Dictate. These Terms of Service ("Terms") govern your use of the Awesome Dictate desktop, mobile, and web application ("App") and related services provided by appsandbrains UG (haftungsbeschränkt) ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

2. DESCRIPTION OF SERVICE

2.1 Awesome Dictate is a desktop, mobile, and web application that lets the user dictate rough text into the app and let AI write the text in a polished way. The user can instruct the AI how to write the text. The utilizes backend servers to communicate with various Large Language Model (LLM) providers.

2.2 We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice.

2.3 Transcription Services: Awesome Dictate provides automated transcription services for audio and video files. Our system uses advanced speech recognition technology to convert spoken words into written text. While we strive for high accuracy, you acknowledge that automated transcription may not be 100% accurate. It is your responsibility to review and correct any errors in the transcriptions before relying on them for critical purposes.

2.4 AI-Powered Content Generation: Our Services include AI-powered tools for generating and enhancing content based on user inputs and transcribed text. You understand that AI-generated content is created based on patterns and data, and while it can be a useful tool, it should not be relied upon as a substitute for professional judgment, especially in legal or medical contexts.

2.5 Service Availability: We aim to provide 99.9% uptime for our Services. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates. We will provide advance notice of any scheduled downtime whenever possible. However, we reserve the right to perform emergency maintenance without prior notice, where necessary, to protect the integrity and security of our Services.

3. USER ACCOUNTS

3.1 You may be required to create an account to use certain features of the App.

3.2 You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. USER CONDUCT

4.1 You agree to use the App only for lawful purposes and in accordance with these Terms.

4.2 You shall not:

a) Use the App to violate any applicable laws or regulations.

b) Attempt to gain unauthorized access to the App or its related systems.

c) Interfere with or disrupt the integrity or performance of the App.

d) Reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without our express written permission.

5. INTELLECTUAL PROPERTY

5.1 The App and its original content, features, and functionality are owned by appsandbrains UG (haftungsbeschränkt) and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 You may not modify, reproduce, or create derivative works based on the App or any part thereof without our prior written consent.

6. PRIVACY

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. THIRD-PARTY SERVICES

7.1 The App may integrate with or use services provided by third-party LLM providers.

7.2 We are not responsible for the content, accuracy, or reliability of any third-party services or content accessed through the App.

8. DISCLAIMER OF WARRANTIES

8.1 The App is provided "as is" and "as available" without any warranties of any kind, either express or implied.

8.2 We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, appsandbrains UG (haftungsbeschränkt) shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

10. INDEMNIFICATION

You agree to indemnify and hold harmless appsandbrains UG (haftungsbeschränkt) and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

12. JURISDICTION

Any disputes arising out of or in connection with these Terms and your use of the App shall be subject to the exclusive jurisdiction of the courts of Buxtehude, Germany. You hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

13. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our website or within the App.

14. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

15. PAYMENT AND ORDER PROCESS

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
